Alexander Yagelnitsky authored an article on “Liability for Invalid Statements”, which saw light in the Zakon Law Magazine in August 2019.
In the article, Alexander comments on decision of the Supreme Court of the Russian Federation dated 05.11.2018 No. 306-ES17-18368 in the Magadan Test case, where the Court recognized the possibility of recovering pure economic losses despite absence of a special regulation to that effect in the statutes. Alexander favors the Court’s directions to resolve cases related to negligent advice, but questions reference to the concept of “absolute right” as a ground for the decision.
